This Privacy Policy describes the types of personal information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, as defined by applicable privacy laws (“Personal Information”), which we may collect, use, or maintain from users of our websites, subscription services (The Hub, The Lab, The Boardroom), Lucy AI, and any related communications or services (collectively, the "Services").  

We are committed to protecting your privacy and ensuring you have a positive experience when using our service. By accessing or using the Services, you agree to the terms of this Privacy Policy, which is incorporated into our Website Terms of Use, Subscription Agreement, and Lucy AI Terms of Use

 

1. PERSONAL DATA  WE COLLECT 

The Personal Information we receive and collect depends on when and how you interact with us, and what you do within our Services. You may be able to improve your experience when you tell us who you are (e.g., by enrolling in our Services, making inquiries, or requesting further information about our Services). However, you can visit our website or certain parts of the specific application without revealing your identity. When you request information or create an account, we will ask you for your Personal Information or obtain such data from third parties. You are free to choose whether to disclose this information to us or not.  

We may collect Personal Information in the following ways: 

 

1.1 Personal Information Collected Directly from you. For example, you may submit a request via our website, complete forms to create an account with us, purchase products or use Lucy AI, or provide Personal Information via the use of our Services. This Personal Information may include: 

  • Name, email address, and contact information 

  • Company details and business information 

  • Billing information and payment details 

  • Prompts, conversations, and uploads submitted to Lucy AI 

  • Demographic Information, including gender, age, and zip code. 

  • Email communications: We may chose to store email or other communication between you and us. This may include copies of your correspondence (including your email addresses), and any information you may provide therein.  

  • Usage Data, including Features and functions used, Frequency of use and session duration, Performance metrics and analytics 

  • Technical Information, including IP address and device identifiers, geolocation information, time zone, language setting, Browser type and operating system, Login information and access times, Referring website and exit pages 

 

1.2  Automatically, when visiting our website or application or using our Services.   

  • Internet or Electronic Activity Information.  We may use cookies, tags, web pixels, and similar technologies to automatically collect information on our Services. Information within this section describes our use of these technologies and your ability to control the use of these technologies. 

  • Cookies.   Cookies are small web files that a website or its provider transfers to your device’s hard drive, through your web browser, that enables the site’s or provider’s system to recognize your browser and remember certain information.  “First-party cookies” are cookies set by us on the Services. “Third-party cookies” are cookies set by other companies whose functionality is embedded into our Services. Generally, we may use first-party and third-party cookies for the following purposes: to make our Services function properly; to provide a secure browsing experience during your use of our Services; to collect passive information about your use of our Services; to measure how you interact with our marketing campaigns; to help us improve our Services; and to remember your preferences for your convenience.   

  • Web Pixels.  To see how successful our marketing campaigns or other goals of the Services are performing, we may use conversion pixels, which fire a short line of code to tell us when you have clicked on a particular button or reached a particular page. We may also use web pixels to analyze usage patterns on our Services. The use of a pixel allows us to record that a particular device, browser, or application has visited a particular webpage.  

  • Analytics.  We may use third-party service providers to monitor and analyze the use of our Services.  Such service providers often have their own separate privacy practices. The types of analytical information that are collected include the date and time the app accesses our servers, app version, the location of the device, language setting, what information and files have been downloaded to the app, user behavior (e.g. what features used, frequency of use), device state information, device model, hardware and operating system information, and information relating to how the app functions. We use this data to improve the quality and functionality of our Services; to develop and market products and features that best serve you and other users; and to help identify and fix app stability issues and other usability problems as quickly as possible.   

  • Java Script.  Pages of our Services may also use Java scripts, which are code snippets embedded in various parts of websites and applications that facilitate a variety of operations including accelerating the refresh speed of certain functionality or monitoring usage of various online components; entity tags, which are HTTP code mechanisms that allow portions of websites to be stored or “cached” within your browser to accelerate website performance; and HTML5 local storage, which allows data from websites to be stored or "cached" within your browser to store and retrieve data in HTML5 pages when the website is revisited. 

  • Other Tracking Technologies.  We may also use tracking technologies to collect "clickstream" data, such as the domain name of the service providing you with Internet access, your device type, IP address used to connect your computer to the Internet, your browser type and version, operating system and platform, the average time spent on our Services, pages viewed, content searched for, access times and other relevant statistics, and assign unique identifiers to the device or other credentials you use to access the Services for the same purposes. 

  • Do Not Track.  Some browsers have a “Do Not Track” (DNT) feature that lets you tell websites and online services that you do not want to have your online activities tracked. Such browser features and industry standards are not uniform. As such, we do not monitor or respond to DNT browser requests.  If a standard is adopted that we must follow in the future, then we will inform you about that practice in a revised version of this Privacy Statement. 

  • Location Information.  You may be able to adjust the settings of your device so that information about your physical location is not sent to us or third parties by (a) disabling location services within the device settings; or (b) denying certain websites or mobile applications permission to access location information, by changing the relevant preferences and permissions in your device or browser settings. 

 

1.3 Personal Information Collected on or via third parties.  

  • If you work for a Company, we may be provided with Personal Information related to you from your employer or Company you are affiliated with 

  • Service providers (e.g. analytics tools, payment processors) 

  • Public sources or marketing partners 

  • We also may obtain Personal Information from other sources, such as through mergers and acquisitions with other companies, as well as through commercial arrangements with third-party providers, business partners, and other sources. Personal Information we receive from a third party is subject to your separate agreement with such third party unless you enter into a separate agreement with us or otherwise give us your permission to use such information. We may merge Personal Information we receive from third parties with Personal Information we have collected or will collect subject to such limitations.

  • To communicate with you by mail, telephone, email, mobile alerts, push messages, and SMS messaging, including about your use of the Services; 

  • Communicate with you about updates and changes to our Services; 

  • Process transactions and send related information; 

  • Respond to your comments, questions, and requests; 

  • Monitor and analyze trends, usage, and activities; 

  • Detect, prevent, and address technical issues; 

  • In response to judicial or other governmental subpoenas, warrants and court orders served on us in accordance with their terms, or as otherwise required by applicable law; 

  • To comply with legal, regulatory or administrative requirements of governmental authorities;

Aggregate Information. We or our affiliated companies, designees, and/or third-party service providers may also use Personal Information to create aggregated data for analytical purposes. This statistical information does not contain any Personal Information and is used to understand our customer base and to better serve our market. We reserve the right to use and share such aggregate data with third parties, such as potential business partners, advertisers, and funding sources, or in order to describe our business and operations. 

 

4. HOW WE DISCLOSE THE PERSONAL INFORMATION WE COLLECT  

At Spire maintaining your trust and confidence is our top priority. Spire may disclose your Personal Information to third parties from time to time.  These types of third parties may include: 

  • Subsidiaries and Affiliates. We may disclose Personal Information about you to our subsidiaries and affiliates. 

  • Analytics Partners. We may share your Personal Information, including, without limitation, your contact information with entities that perform marketing or data aggregation services on our behalf, or with which we or an affiliate has joint marketing arrangements. We may share Personal Information, including without limitation your device information, location, usage data, and IP address, to analytics-based technologies to assist with personalization, advertising, and marketing. These technologies capture how you interact with our Services through behavioral metrics to improve and market our products and Services.   

  • Authorized Representatives. If another individual is managing your account with us or your email account, which the Services connect to on your behalf (for example, a manager managing the account of an employee), as authorized by you or as a personal representative under applicable law, that person can view all Personal Information about you on the Services. 

  • In the Event of a Merger, Sale, Divestiture, or Change of Control. We reserve the right to transfer Personal Information to a buyer or other successor in interest that acquires rights to that information as a result of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of us or substantially all of its assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about you is among the assets transferred.  

  • With Your Consent. We may share your information for other purposes pursuant to your consent or at your direction.  

  • Other Disclosures. We may disclose your Personal Information if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) conform to legal requirements and comply with any court order, law, or legal process, including responding to any government, law enforcement, or regulatory request; (ii) enforce the Terms of Service, other agreements, including between you and us, and any other documents included or referenced therein (all of which are incorporated into and made a part of this Privacy Statement by reference); (iii) fulfill the purpose for which you provide it; (iv) detect, prevent, or otherwise address fraud or security issues; or (v) protect against harm to our, your, or third parties’ rights, property, or safety.  

We may share and disclose de-identified and/or aggregate analytics with third-party partners for any legal purpose, including, when and where applicable, sharing and disclosing non-personally identifiable information combined with Personal Information. 

 

5.  NETWORK OPERATORS. Use of the Services may involve use of the services of third-party telecommunications carriers and service providers (such as the services of the carrier that provides cellphone service to you). Such carriers and service providers are not our contractors, and any information that a carrier collects about your use of the Services is not Personal Information and is not subject to this Privacy Statement. We are not responsible for the acts or omissions of telecommunications carriers or service providers. 

6. PAYMENT PROCESSING All payment transactions are processed via Stripe. HBC does not store full credit card numbers or sensitive payment details. Stripe's privacy policy governs the use of that information and is available at https://stripe.com/privacy

7.  SECURITY 

We use reasonable security precautions to protect the security and integrity of your Personal Information in accordance with this policy and applicable law. However, no system or online transmission of data is completely secure, and we cannot guarantee that security breaches will not occur. You should always take appropriate security measures to protect your Personal Information, including ensuring you have up-to-date anti-virus software. We may assign you a user ID and a password as part of your participation and access to our Services. Only you may use your user ID, and password. You may not share your user ID or password with anyone else, and you are solely responsible for maintaining and protecting the confidentiality of your user ID and password. Without limitation of the foregoing, we are not responsible for the actions of hackers and other unauthorized third parties. 

Suspicious E-Mail. We will never e-mail you to request Personal Information over the Internet or by any other means. Help protect yourself against online fraud – if you suspect that an unsolicited e-mail is fraudulent, please contact us. 

 

8.  DATA RETENTION We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. 

 

9. SERVICE  

Our business and the Services are located within the United States and are subject to the applicable state and federal laws of the United States. If you choose to access or use the Services, you consent to the use and disclosure of information in accordance with this Privacy Statement and subject to such laws. Of note, the laws in the United States may not provide the same protections for your Personal Information as the jurisdiction in which you are located. Do not provide your Personal Information to us if you do not want this information to be transferred or processed outside of your country or if the laws in your country restrict such transfers. 

 

10.  CALIFORNIA PRIVACY RIGHTS 

This section applies to residents of California and provides residents with certain rights regarding Personal Information (“consumers” or “you”). This section uses certain terms that have the meaning given to them in the CCPA, including Personal Information.  The following do not apply to individuals who do not live in these states on a permanent basis.   

10.1 Shine the Light. Under California Civil Code Section 1798.83 (“Shine the Light”), California residents have the right to request in writing from businesses with whom they have an established business relationship (a) a list of the categories of Personal Information, such as name, e-mail and mailing address and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes; and (b) the names and addresses of all such third parties. To request the above information, please contact us as directed in the CONTACT US section below with a reference to California Disclosure Information. 

10.2 California residents have rights under the California Consumer Privacy Act (CCPA), including: 

  • The right to know what Personal Information we collect 

  • The right to request deletion 

  • The right to correct inaccurate data 

  • The right to non-discrimination for exercising your privacy rights 

We do not sell Personal Information or share it for cross-context behavioral advertising.

11.  CHILD PRIVACY 

Our Services, including Lucy AI, are not intended for users under age 18. If you are under 18 years of age, then please do not use the Services.  We do not knowingly collect personal information from children under 16 years of age. If we learn that we have collected personal information from a person less than 16 years of age without verifiable parental consent, we will take steps to delete such information. If you believe a child under the age of 16 has provided us with Personal Information, please contact us, as directed in the CONTACT US section below. 

 

12.  CHANGES TO PRIVACY POLICY 

We may update our Privacy Policy from time to time to reflect how we process your Personal Information, and if we make changes, we will revise the effective date or last modified date at the top of this Privacy Policy. If we make changes that materially affect your privacy rights, we will attempt to provide advanced notice (in nearly contemporaneous disclosures) or otherwise via the app, website, email, or by some other means of contact so that you have a reasonable opportunity to review the changes before you continue to use the Services. If you disagree with a future, modified version of this Privacy Policy, then please stop using the Services at such future time.
