Purchase Terms for The Shop.

These Purchase Terms (“Terms”) govern your purchase of digital products, toolkits, templates, or other downloadable materials (“Products”) from The Shop offered by Her Brand & Co., a Full Tilt Company (“HBC,” “we,” “us,” or “our”). By completing a purchase through The Shop, you agree to be bound by these Terms, as well as our Website Terms of Use, Privacy Policy, and any additional terms presented at checkout. 

1. Eligibility 

You must be at least 18 years old and capable of entering into a legally binding contract to make a purchase. By placing an order, you represent and warrant that you meet these requirements. 

2. Digital Product Delivery 

All products sold through The Shop are digital in nature. Upon successful payment, you will receive a download link or account-based access to the Product via email or through your user dashboard. You are responsible for ensuring that your device is compatible with the file format provided. 

3. License and Permitted Use 

When you purchase a Product, you are granted a limited, non-exclusive, non-transferable license to use it for your personal or internal business purposes only. 
You may not: 

  • Share, resell, distribute, sublicense, or reproduce the Product; 

  • Modify or create derivative works based on the Product, except where explicitly allowed; 

  • Use the Product for commercial resale or redistribution purposes. 

All Products are protected by copyright and other intellectual property laws and remain the property of HBC or its licensors. 

4. No Refunds 

Due to the digital nature of the Products and immediate access upon purchase, all sales are final and non-refundable, regardless of your usage level or satisfaction.

5. Pricing and Payment 

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. Taxes may be applied based on your billing location. Payment is due at the time of purchase and is processed securely through Stripe, our third-party payment provider. 

We reserve the right to cancel or refuse any order if we suspect fraud, unauthorized activity, or violation of these Terms. 

6. Intellectual Property 

All rights, title, and interest in the Products, including all associated intellectual property, remain with HBC or its licensors. Purchase does not transfer ownership or grant any rights not expressly provided in these Terms. 

7. Account Access and Technical Support 

If your purchase is tied to a customer account, you are responsible for maintaining the confidentiality of your login credentials. If you encounter issues accessing your Product, please contact [email protected] for support. 

8. Disclaimers 

Products are provided “as is” and without warranties of any kind. HBC makes no guarantees about specific results or outcomes based on the use of any Product. We disclaim all implied warranties, including merchantability and fitness for a particular purpose. 

9. Limitation of Liability 

To the maximum extent permitted by law, HBC will not be liable for any indirect, incidental, or consequential damages arising from your purchase or use of a Product. Our total liability, if any, shall not exceed the amount paid by you for the Product. 

10. Governing Law 

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Atlanta, Georgia.
